MUUT South Africa ("the Website") sets out this Privacy Policy to explain how personal information is collected, used, retained and protected. By clicking "Agree" during sign-up, you consent to the collection and use of your personal information as described below.

The Website establishes a procedure for customers to click "Agree" to the terms of use, the collection of personal information, and the details of how personal information is used. Customers are deemed to have agreed to the collection and use of their personal information by clicking "Agree".

General members

• Time of collection: signing up for membership

• Retention: deleted immediately upon withdrawal of membership, or retained for five (5) years for purchasing members

Article 3 — Collection of Personal Information via Cookies

The Website may install and operate cookies that store and retrieve customer information. A cookie is a small text file sent by a website to a user's browser.

Purposes of using cookies

Article 4 — Retention Period and Destruction of Personal Information

Personal information is destroyed without delay once its purpose has been fulfilled, except where retention is required by law to verify the rights and obligations of transacting parties, for example:

• Records of contracts or withdrawal of offers: five (5) years
• Records of payment and supply of goods: five (5) years
• Records of complaint or dispute resolution: three (3) years
• Login records: three (3) months

Information is transferred to a separate, access-controlled store for the required retention period and then destroyed — paper records by shredding or incineration, and electronic records by secure deletion methods that prevent recovery. Members inactive for twelve (12) consecutive months will be notified before their account and personal information are separated from active records and, eventually, destroyed after the applicable retention period.

Article 5 — Provision of Personal Information to Third Parties

The Website does not use or share customers' personal information beyond the purposes described in Article 2, except where:

• required by a relevant authority for investigative purposes under applicable law;
• provided in a de-identified, aggregated form for statistical, academic or market research; or
• requested through a pre-determined legal process under other applicable law.

Article 2 — Definitions

• Member: a user who has registered with the Website by agreeing to these terms and providing their personal information, and who has entered into a user agreement with the Website.
• User Agreement: the agreement between the Website and a Member regarding use of the Website.
• Member ID: a unique identifier assigned to each Member for identification and use of services.
• Password: a credential chosen by a Member to verify their identity and protect their account.
• Operator: the person or entity that operates the Website and provides its services.
• Termination: a Member ending their user agreement with the Website.

Article 3 — Rules Other Than These Terms

The Operator may separately announce operational policies where necessary. Where these Terms and an operational policy overlap, the operational policy shall prevail.

Article 4 — Formation of the User Agreement

The user agreement is formed when a person who wishes to use the Website agrees to these Terms and the Operator accepts their application for membership. A person indicates agreement by reading these Terms and clicking "I agree" when applying for membership.

Article 5 — Applying to Use Services

Anyone wishing to become a Member must provide the information requested by the Website (such as user ID, password, and nickname). A Member who registers using stolen or false information may not claim any right to use the Website and may be subject to legal consequences.

Article 6 — Personal Information

The Website and Operator do not hold Members' passwords in plain form. Personal information is handled in accordance with applicable law and the Website's Privacy Policy. The Operator is not liable for information leaked due to a reason attributable to a Member. If a Member posts or distributes unlawful content — including content that disrupts public order or violates the law — the Operator may provide relevant materials to the appropriate authorities upon lawful request.

Article 7 — Operator's Obligations

• The Operator will address reasonable Member complaints and feedback as promptly as possible, including via notices, messages, or email where immediate resolution isn't possible.
• Where equipment failure or loss occurs, the Operator will act promptly to repair or restore it for continuous, stable service — except where natural disasters or other circumstances beyond the Operator's or Website's control require a temporary suspension of service.

Article 8 — Members' Obligations

• Members must comply with these Terms, the Website's policies and notices, and applicable law, and must not act in a way that disrupts the Website's business or harms its reputation.
• Members may not transfer, assign, or use as security their right to use the Website's services without the Website's express consent.
• Members must take reasonable care to protect their ID and password and must not allow third parties to use their account without the Operator's consent.
• Members must not infringe the intellectual property rights of the Operator, the Website, or any third party.

Article 9 — Service Availability

Services are, in principle, available 24 hours a day, 365 days a year, except for operational or technical reasons. The Website may temporarily suspend services for scheduled maintenance, upgrades, or replacements, and will announce such suspensions on the homepage in advance where possible. The Website may also suspend services without prior notice in the event of:

• urgent system maintenance, upgrades, replacement, breakdown, or malfunction;
• force majeure events such as national emergencies, power outages, or natural disasters;
• disruption of telecommunications services by third-party carriers; or
• service delays caused by unusually high traffic.

Where possible, the Website will notify Members in advance of any suspension; where a prior notice isn't possible, notice will be given afterward instead.

Article 10 — Termination of Use

A Member who wishes to end their user agreement may apply to close their account online. Once an account closure is processed, related account information may no longer be accessible to the Operator.

Article 11 — Restrictions on Use

The Website may restrict a Member's use of services, take legal action, terminate the user agreement, or suspend service for a period of time if a Member is found to have:

• registered false information when signing up, or later changed their information to be false;
• hindered other users or stolen their information;
• impersonated Website staff, management, or affiliated personnel;
• infringed the moral or intellectual property rights of the Website or a third party, or disrupted their business;
• fraudulently used another Member's account;
• collected, stored, or disclosed another Member's personal information without consent;
• engaged in conduct reasonably believed to be connected to criminal activity; or
• otherwise violated applicable law.

Article 12 — Management of Postings

The Operator is responsible for managing content and postings on the Website and will monitor them on an ongoing basis. Where faulty postings are found or reported, the Operator may delete them and warn the Member responsible. Members remain responsible for their own postings and must not post content that violates these Terms. Content may be considered faulty where it:

• seriously insults or defames another Member or third party;
• distributes or links to content that violates public order or decency;
• promotes illegal copying or hacking;
• is posted purely for commercial advertising purposes;
• is reasonably connected to criminal activity;
• infringes the rights (including copyright) of another Member or third party; or
• otherwise violates applicable law.

Where a competent authority or a third party lawfully requests that a posting be corrected, removed, or relocated due to defamation or rights infringement, the Operator may act on that request, including without the posting Member's prior consent, and will comply with any resulting binding decision or settlement it is made aware of.

Article 13 — Custody of Postings

If the Operator must suspend the Website's operation due to unavoidable circumstances, it will give advance notice and make reasonable efforts to allow Members to transfer their postings beforehand.

Article 14 — Copyright in Postings

Members retain copyright in the materials they post. The Website will not use such materials commercially without the posting Member's consent, but may use them for non-commercial purposes and display them within its services. Members may not use content from the services for their own commercial purposes, including reselling or repackaging information obtained through the Website. The Operator may remove, relocate, or refuse to publish postings that fall under Article 12 above, without prior notice.

Article 15 — Damages

Members are primarily responsible for any civil or criminal liability arising from their use of the Website. The Website is not liable for damage caused by force majeure events, or by a Member's own willful misconduct or negligence.

Article 16 — Limitation of Liability

• The Operator is not liable where a Member earns no benefit from the services provided, or where damage arises from a Member's own choices in using optional service features.
• The Operator is not liable for disruptions caused by third-party telecommunications providers.
• The Operator is not liable for content stored, posted, or transmitted by Members.
• The Operator is not liable for service disruptions caused by a Member's own actions.
• The Operator is not liable for interactions between Members, or between Members and third parties, whether on or off the Website.
• The Operator does not guarantee the accuracy, reliability, or authenticity of content posted or transmitted by Members or otherwise made available via the Website.
• The Operator is not liable for disputes arising from transactions between Members or between Members and third parties conducted via the services.
• The Operator is not liable for disputes between Members, or between Members and third parties, that do not arise from a reason attributable to the Operator.
• The Operator is not liable for damage caused by system disruptions arising without its willful misconduct or gross negligence — including issues arising during routine server or software maintenance — nor for damage caused by third-party attacks or malware not yet identifiable by recognised security researchers, or other force majeure events beyond the Operator's control.
